A last will and testament provides you with the means to decide for yourself exactly what happens with your worldly assets upon your death. In Attorney Yancey's experience, nothing can divide a family like disputes over assets left by a loved one. A will becomes one's final act in that one's personal feelings, wants, and desires for loved ones are expressed through a will in what one wants certain individuals to have and care for after one dies. Wills can be devices to establish education funds for younger children, pass on a home to a relative in need, distribute financial assets, place your cherished family heir looms in the right person's hands, and even establish a plan for your funeral. A will will establish who handles your assets until they are distributed and who will be responsible for paying your last debts. To assist clients, Attorney Yancey has developed a will form package to assist clients in understanding the types of gifts that can be made and in providing forms to organize their assets. 
POWERS OF ATTORNEY

A power of attorney is a legal device used to pass certain types of powers from one individual to another. A general power of attorney provides the recipient of the power with the broadest spectrum of powers over another's finances, assets, personal property, real property, accounts of all kind, and even over decisions for another's children. A specific power of attorney provides the recipient of the power with limited and specific powers over a certain aspect, item, area, or one certain transaction. A power of attorney can be designed to expire on a certain date or last indefinitely. A power of attorney can be dissolved before an expiration date when certain actions are taken to prematurely end the power.

Attorney Yancey has helped clients with powers of attorney most often to (1) handle the general affairs of a loved one who lacks the physical and/or mental ability to care for their own affairs and (2) in business for the handling of business operations if a key employee can not physically or menatlly carry out his or her duties, such as when one is seriously injured or dies unexpectedly. 
ADVANCED MEDICAL DIRECTIVES

An advanced medical directive is a legal instrument created by a person for the purpose of determining himself or herself how he or she will be cared for in the event he or she is being kept alive only by extraordinary life saving equipment. An advanced medical directive can address how health care professionals should handle this type of situation or you can elect a person to have the responsibility for making a medical treatment decision for you in your incapacity in such an event. Without an advanced medical directive, your life will be in the hands of health care providers alone or in the hands of a family member that you may not trust with making decisions about your being kept alive only by extraordinary equipment. As difficult as this type of situation is, the creation of an advanced medical directive can give you and your family the assurance that the right person will be deciding your fate if such an event occurs and you can not indicate your desires to the medical providers.
